The NYPD supervisors of a cop who drank excessively one day in April 2014 and pumped 14 bullets into the car of two Westchester businessmen stopped at a traffic light might be on the hook for damages, a Manhattan federal judge ruled Friday.

Judge Alvin Hellerstein said he will permit Joseph Felice, the businessman almost killed in the hail of bullets, to sue the supervisors — Lt. Kevin Brown and Sgt. Joseph Simonetti — because he contends they tolerated an "atmosphere of indifference to alcoholism" by police trainees under them.
Officer Brendan Cronin's unprovoked, whiskey laced, wild assault on Felice and his friend occurred in Pelham, five hours after he finished stressful training at Rodman's Neck on City Island in how to conduct high intensity car stops.Cronin, 29, of Yonkers, got 9 years in jail after pleading guilty to attempted murder, assault and driving while intoxicated. He admitted he had been drinking heavily with fellow officers while on duty during a lunch break and then resumed the binge on whiskey and beer after work.City attorney Mark Zuckerman argued that neither Brown nor Simonetti should be part of the case because they didn't know Cronin and other officers were drinking at lunch or later and had no responsibility for supervising them beyond training them.Felice's lawyer Debra Cohen said "the public should be able to expect zero tolerance for alcohol abuse" by cops on duty or off. "If the NYPD's own trainers aren't enforcing this, then who is?" she asked.
